We at Voiijer respect your concerns about privacy and value the relationship we have with you. We want you to be familiar with how we collect, use, and disclose information about you. This Privacy Policy describes our practices in connection with the Platform and other information collection sources. This Privacy Policy applies to all of the sites and apps where it appears and that are part of our Platform. If we use a defined term in this Privacy Policy, it has the meaning assigned to it in the Terms of Use.

  1. Information We Collect

We collect information from different sources and in different ways depending on how you interact with us. We collect information when you:

  • Use the Platform, including creating an account
  • Sign up to receive email communications from us
  • Visit our Website at voiijer.com, which is part of the Platform

Depending on how you interact with us, the information you provide or we collect may include:

  • Your name
  • Your address
  • Your zip code
  • Your email address
  • Your telephone number
  • Your birthdate
  • Your account username
  • Your IP address
  • Your device information
  • Your location, if you provide consent when asked
  • The ways in which you interact with the Platform
  • If you participate in one of our surveys, promotions, or sweepstakes, we may ask for additional information, such as your interests.
  • When you use the Platform, your browser automatically sends certain information that may include browser type, language preference, operating system, internet service provider, internet protocol (IP) address, device identification number, geo-location data, and online browsing data (such as date and time of access to our Platform, referring Platform address, pages viewed, features used, links clicked, and other actions you take in connection with the Platform, sometimes referred to as “clickstream data”).
  • Any other information you volunteer on your profile or on the Platform

You have the right to request that we delete any personal information collected from you. To make such a request, please send us your request via email to privacy@voiijer.com and reference “Data Deletion Request” in the subject line. Please include your full name.

  1. How We Use the Information We Collect

We use the information we collect about you in the following ways:

  • To populate the Platform. We use your username and other information you choose to disclose to other users of the Platform to let them know about you.
  • To communicate with you. We use the contact information you provide to communicate with you, send news, service, and promotional information, and to respond to your inquiries.
  • For administrative purposes. We use your information to process your transactions, provide customer service, and assist you with inquiries about our services.
  • For marketing purposes. We use your information for marketing purposes including, but not limited to, notifying you of special promotions, offers, and events via email, direct mail, social media, and other means.
  • To improve our Platform. The information we collect helps us customize content on the Platform, facilitate access to our Platform, and recognize a computer or device that has visited our Platform before. It also helps us detect potential problems on the Platform, analyze the functionality of the Platform, and improve the user experience.
  • For data analytics purposes. We combine information about the users of our Platform to produce aggregated statistical information that helps us understand the frequency of visits to the Platform, the pages visited, and the features accessed.
  • For legal purposes. We also use the information we collect where necessary to protect against, and identify, fraud and other prohibited activity, to comply with law or a legal obligation to which we are subject, or to exercise or defend legal claims.

We will retain the information we collect about you for as long as reasonably necessary to maintain the Platform, to meet legal and accounting obligations, for the other purposes described in this Privacy Policy, or as otherwise required or permitted by law, unless specifically authorized or required to be retained longer nor for less time. We may anonymize and/or aggregate the information we collect about you and store it in order to analyze aggregate metrics and trends. When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.

  1. How We Share the Information We Collect

We may share the information we collect:

  • With our contractors, agents, or business partners so that they may perform services for us, which may include supporting the Platform, sending communications for us, executing marketing programs and promotions, and processing payments. We do not authorize these service providers to use or disclose your information except as necessary to perform services on our behalf or to comply with legal requirements.
  • With our affiliates for purposes of supporting our business operations, which may include legal and administrative support.
  • With other third parties, such as law enforcement or other government entities: (1) if we believe there has been a violation of the Terms of Use or other Platform policies; (2) if we believe that someone may be causing injury to our rights or property, other users, or anyone else; (3) to respond to judicial process or to provide information to law enforcement; or (4) as required by law.
  • In the event of a sale or restructuring of the business, such as a merger, acquisition, bankruptcy, or other sale of all or a portion of the company’s assets. In such an event, we will use reasonable efforts to ensure the transferee uses your information in a manner consistent with this Privacy Policy.
  1. Our Use of Cookies

We and our third-party service providers set and use cookies and similar technologies to store and manage user preferences, enable content, gather analytic and usage data, and deliver targeted advertising. A cookie is a small text file that is placed on a computer or other device and is used to identify the device and to collect information. Cookies are typically assigned to one of the following categories, depending on their function and intended purpose:

  • Essential cookies enable you to navigate the Platform and to use its services and features. Without these cookies, the Platform will not perform as smoothly for you as we would like, and we may not be able to provide certain core functions and features.
  • Analytics cookies collect information about the use of the Platform and enable us to improve the way it works. For example, analytics cookies show us the most frequently visited pages and analyze site traffic. We use them to look at overall patterns of usage on the Website, rather than the usage of any particular individual.

We use third-party service providers, including Google Analytics, to analyze use of the Platform. You can prevent your data from being used by Google Analytics at any time by either downloading and installing a or by configuring your browser to delete and reject cookies.   • Social Media cookies collect information about your use of the Platform, but only when you are logged in to your social media account.
  • Customer interaction cookies allow us to communicate with you, including real-time communication, such as through any chat feature we may offer.
  • Marketing cookies track browsing habits and are used to deliver targeted (interest-based) advertising. You can opt out of receiving interest-based ads for web properties (Digital Advertising Alliance’s WebChoices).

Most browsers are set up to accept cookies automatically. You can deactivate the storing of cookies or adjust your browser to inform you before the cookie is stored on your computer. Some browsers have “do not track” features that allow you to tell a platform not to track you. These features are not all uniform. We do not currently respond to those signals. Customers within the EEA will be asked for consent prior to the setting of cookies.

  1. Third Party Social Media Platforms

We use social media accounts such as those on Instagram, Facebook, Twitter, YouTube, and LinkedIn to engage with the public. Our social media accounts are produced and maintained by our communications personnel, sometimes working with service providers. Through our social media engagement, we are able to build online awareness about our company and our services, respond to messages through the comment, message, or chat functions, collect aggregated information about interactions with our content on or through social media, and analyze trends. When you engage with us through our social media channels, the platform providers will also process information about you.   1. Your Choices and Communication Preferences

You can modify information you have given us. To correct or delete information or update account settings, log into your account and follow the instructions. If action is required by us, we will make changes as soon as we can. This information may stay in our backup files. If we cannot make the changes you want, we will let you know and explain why.

You can control settings on your mobile device. For example, you can turn off the GPS locator or push notifications on your device.

To stop receiving our promotional emails, email us at privacy@voiijer.com with specific instructions to stop sending you our promotional emails or follow the instructions within any marketing email you get from us. It may take about ten days to process your request. Even if you opt out of getting marketing emails, we will still send you transactional messages. For example, we may still contact you about changes you make to your account.

  1. Children

We do not knowingly collect the personal information of children under the age of 13. The Platform is not directed to, or intended for use by, children under the age of 13. If we learn that a person under the age of 13 has provided personal information to us or that we otherwise have collected such information, we will delete it. For children located in jurisdictions within the EEA, where this Privacy Policy refers to consent, this will require the consent of a parent or legal guardian in relation to any person under the age specified by the law applicable to the location of the child in question.

  1. Links to Third Party Sites

From time to time, we may provide links to unaffiliated third-party platforms. Those platforms operate independently from us and our affiliates and may have their own privacy policies in place which we recommend you review if you visit any linked platforms. The ability to access information of third parties from our Platform, or links to other websites, locations, products, services, or other platforms is for your convenience and does not signify our endorsement of such third parties, their services, other platforms, locations, or their contents.

  1. Security

We recognize the importance of maintaining the security of your information. We have implemented technical, administrative, and physical security measures designed to protect your information from unauthorized access, disclosure, use, and modification. Please be aware though that no security measures are perfect or impenetrable. We recommend that you help us keep your data safe by taking reasonable steps such as keeping your password private and not disclosing sensitive personal data in places that can be accessed by other users or the public.

  1. State Law Privacy Rights

Except as otherwise provided, this section applies to residents of California, Virginia, and other states to the extent they have privacy laws applicable to use that grant their residents the rights described below.

For purposes of this section, Personal Information has the meaning given to “personal data,” “personal information,” or similar terms under the applicable privacy laws of the state in which you reside. Please note that not all rights listed below may be afforded to all users and that if you are not a resident of the relevant states, you may not be able to exercise these rights. In addition, we may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it.

In some cases, we may provide a different privacy notice to certain categories of residents of these states, such as job applicants, in which case that notice will apply with respect to the activities it describes instead of this section.

Your privacy rights. You may have some or all of the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

  • Right to information/know. You can request the following information about how we have collected and used your personal information during the past 12 months:
    • The categories of personal information that we have collected.
    • The categories of sources from which we collected personal information.
    • The business or commercial purpose for collecting and/or selling personal information.
    • The categories of third parties with whom we share personal information.
    • Whether we have disclosed your personal information for a business purpose, and if so, the categories of personal information received by each category of third party recipient.
    • Whether we have sold your personal information, and if so, the categories of personal information sold to each category of third- party recipient.
  • You can request a copy of the personal information that we have collected about you during the past 12 months.
  • You can ask us to correct inaccurate personal information that we have collected about you.
  • You can ask us to delete the personal information that we have collected from you.
  • Opt-out:
    • Opt-out of the “sharing” of personal information (i.e., tracking for targeted advertising purposes). We do not currently do this. You can opt out of certain future tracking activities for targeted advertising (also known as interest-based advertising) purposes.
    • Opt-out of profiling. If we process your personal information for profiling purposes as defined by applicable privacy laws, you can opt-out processing.
    • Opt-out of the “sale” of personal information. We do not currently do this. You may ask us not to “sell” personal information we have collected about you to third parties now or in the future. The right to opt-out of “sales” is separate from opting-out of our direct communications with you for marketing purposes.
    • Opt-in. If we know that you are 13-15 years of age, we will ask for your affirmative authorization to “sell” your Personal Information or “share” your Personal Information for targeted advertising purposes before we do so.
    • Sensitive personal information. You have the right to limit certain uses or disclosures of sensitive personal information; however, we do not use or disclose sensitive personal information for purposes that California residents have a right to limit under the CCPA.
    • You are entitled to exercise the rights described above free from discrimination in the form of refusal to provide access to our services or legally prohibited changes to the price or quality of the services.
  • How to exercise your rights. You may exercise your privacy rights described above via email to privacy@voiijer.com with “Privacy Request” in the subject line, or by completing and submitting this form.
  • We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
  • If you are a resident of Virginia, you can ask to appeal any denial of your request in the same manner through which you may submit a request.
  • Verification of identity; Authorized Agents. We reserve the right to confirm your California residency to process your requests and will need to confirm your identity to process your requests to exercise your information, access, or deletion rights. As a part of this process, government identification may be required. Consistent with applicable law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification.

  1. EU, EEA, and UK Residents

For Platform users within the European Union, European Economic Area, or the United Kingdom (collectively for the purposes of this Privacy Policy, the “EEA”), Voiijer is the data controller of your personal data, which we also refer to as personal information. To contact us, please see the contact details at the end of this Privacy Policy.

The legal basis on which we process your personal information. In some cases, such as where you use the Platform, the processing of your personal information will be necessary in order for us to perform under an agreement with you (i.e., the Terms of Use). In many other cases, the processing will be necessary for the purpose of legitimate interests we are pursuing, namely the facilitation of the purposes for which your personal information is processed as set out above in this Privacy Policy.

Retention. We store the information we collect about you for different periods of time consistent with the purposes for which it was originally collected, as subsequently further authorized, or when required or allowed under applicable law.

Transferring our personal data across borders. When you use the Platform, it may often be necessary to transfer your personal information in order for us to perform under our agreement with you. In addition, we may in some circumstances rely on your express consent. If you submit personal information to us, you will be voluntarily transferring this personal information to the United States, a jurisdiction which does not provide the same framework as the EEA for the protection of personal information.

Your rights. You have certain data subject rights which may be subject to limitations and/or restrictions. These rights may include the right to: (i) request access to and rectification or erasure of your personal data; (ii) obtain restriction of processing or to object to processing of your personal data; and (iii) the right to data portability. If you are aware of changes or inaccuracies in your information, you should inform us of such changes so that our records may be updated or corrected. You may lodge a complaint with your local supervisory authority if you consider that our processing of your personal information infringes applicable law. We will respond to your request without undue delay. We will respond to your request within 30 days except that we may extend such 30-day period for two additional months where necessary, taking into account the complexity and number of the requests. We will let you know of any such extension within one month of receipt of your request, together with the reasons for the delay.

  1. Changes to this Privacy Policy

This Privacy Policy may be updated periodically and will be posted on the Platform, indicating when it was last updated. If there are material changes to this Privacy Policy, we will post a prominent notice on the Platform and/or provide other notice as required by law. Any changes to this Privacy Policy will be effective when posted. In all cases, your continued use of the Platform after the posting of any updated version of this Privacy Policy indicates your acceptance of the updated Privacy Policy.
